1. Overview

This website is operated by FRANCIERA LLC, a Wyoming limited liability company, under the Franciera brand. Throughout these Terms, "Franciera," "we," "us," and "our" refer to FRANCIERA LLC. Our store is hosted by Shopify, which provides the ecommerce platform used to offer our products and services.

These Terms of Service apply when you visit the website, use its features, communicate with us, or purchase a product. By using the website, you agree to these Terms and to the policies linked from the website. If you do not agree, do not use the website or place an order.

2. Eligibility

You must be legally capable of entering into a binding contract in your country or region. If you are under the age of majority, you may use the store only with the involvement and permission of a parent or legal guardian.

3. Product information

We aim to describe products, sizes, materials, colors, and included items accurately. Screen settings, lighting, photography, manufacturing variation, and hand measurement can cause reasonable differences. Measurements should be compared with the product-specific size guide rather than relying only on a usual label size.

Product images may include styling items that are not included in the purchase. The product description identifies what is included. Contact us before ordering if any product detail is unclear.

4. Availability and order acceptance

Products and sizes are subject to availability. Adding a product to the cart does not reserve inventory. We may limit quantities, decline an order, or cancel an order when a product is unavailable, pricing or product information is materially incorrect, payment cannot be authorized, fraud is suspected, or the order cannot lawfully be fulfilled.

An order confirmation acknowledges that we received your order. Acceptance occurs when the order is processed for fulfillment. If we cancel a paid order, we will refund the affected amount to the original payment method.

5. Prices, currency, taxes, and charges

Prices are shown in the currency selected or presented by the store. Currency conversions may be estimates and payment providers may apply their own conversion rate or fees. Taxes and import duties are included in the product price. Any shipping charges are shown at checkout before payment.

International orders include taxes and import duties in the product price, with no additional import taxes or duties payable on delivery. If a carrier or customs authority requests such a payment, contact support@franciera.com with your order number and the notice before paying. See our Shipping Policy.

6. Payment

You agree to provide current, complete, and accurate billing and payment information. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges. Payments are processed by Shopify and the payment providers displayed at checkout.

7. Shipping and delivery

Processing and delivery estimates are provided in our Shipping Policy. Delivery dates are estimates unless we expressly confirm otherwise in writing. You are responsible for providing a complete and accurate delivery address and for complying with destination-country import requirements.

8. Returns, exchanges, and refunds

Returns, exchanges, and refunds are governed by our Return and Refund Policy. That policy forms part of these Terms.

9. Customer communications

You agree that order and service communications may be sent electronically to the email address or telephone number supplied with your order. Marketing messages are sent only in accordance with the choices available to you, and you may unsubscribe from marketing emails using the link provided in those messages.

10. Acceptable use

You may not use the website or its content for an unlawful, fraudulent, abusive, or harmful purpose. You may not interfere with the website's security or operation, introduce malicious code, scrape or copy content through unauthorized automated means, impersonate another person, submit false information, or attempt to gain unauthorized access to any system or account.

The website design, text, graphics, logos, product presentation, photographs, and other content are owned by Franciera or used with permission and are protected by applicable intellectual property laws. You may use the website for personal shopping purposes. No content may be reproduced, distributed, sold, or commercially exploited without prior written permission.

12. Reviews and submitted content

If you submit a review, photograph, comment, or other content, you confirm that it is accurate, lawful, and yours to share. You grant Franciera a non-exclusive, worldwide, royalty-free license to display and use that content for operating and promoting the store, subject to applicable privacy law. We may remove content that is unlawful, misleading, abusive, infringing, or unrelated.

The website may use or link to services provided by Shopify, payment providers, carriers, analytics providers, and other third parties. Their own terms and privacy practices may apply. We are not responsible for third-party websites or services outside our reasonable control.

14. Service availability and corrections

We may update products, prices, content, or website features and may correct errors or omissions. We do not guarantee that the website will always be available, uninterrupted, secure, or free from errors, but we will take reasonable steps to maintain the service.

15. Disclaimer and limitation of liability

To the maximum extent permitted by law, the website and its content are provided on an "as available" basis. Franciera is not liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits any mandatory consumer rights. Where liability can lawfully be limited, Franciera's aggregate liability relating to a product order will not exceed the amount paid for the affected order.

16. Indemnity

To the extent permitted by law, you agree to be responsible for losses reasonably incurred by Franciera because of your unlawful use of the website, your material breach of these Terms, or your infringement of another person's rights.

17. Severability and waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

These Terms and any dispute relating to them are governed by applicable law. Nothing in these Terms limits any mandatory consumer protection rights that apply in the country or region where you live.
